DMCA Policy

Belgische Universiteit Pettit ("BUP") respects the intellectual property rights of others and expects its users to do the same. This Digital Millennium Copyright Act ("DMCA") Policy outlines the procedures for reporting alleged copyright infringement and for submitting counter-notifications regarding content hosted on our websites or services.

It is BUP's policy to respond to clear notices of alleged copyright infringement that comply with the DMCA. We will expeditiously remove or disable access to the material claimed to be infringing. If you believe that material on a BUP-operated site or service infringes your copyright, please provide a written notification to our Designated Copyright Agent, containing the information outlined below.

Filing a DMCA Notice of Infringement

To file a notice of infringing material, please provide the following information in writing to our Designated Copyright Agent:

  1. Identification of the Copyrighted Work: A description of the copyrighted work that you claim has been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.
  2. Identification of the Infringing Material: A description of the material that you claim is infringing and where it is located on our site or service (e.g., URL, specific page name, or file path).
  3. Your Contact Information: Your name, address, telephone number, and email address.
  4. Statement of Good Faith Belief: A statement that you have a good faith belief that the use of the copyrighted material is not authorized by the copyright owner, its agent, or the law.
  5. Statement of Accuracy and Authority: A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.
  6. Physical or Electronic Signature: A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.

Filing a DMCA Counter-Notification

If you believe that your material was removed or disabled by mistake or misidentification, you may submit a counter-notification to our Designated Copyright Agent. A counter-notification must be in writing and contain the following information:

  • Identification of Removed Material: Identification of the material that has been removed or to which access has been disabled and the location (e.g., URL) at which the material appeared before it was removed or disabled.
  • Statement Under Penalty of Perjury: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Your Name, Address, and Telephone Number: Your name, address, and telephone number.
  • Consent to Jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which Belgische Universiteit Pettit may be found.
  • Acceptance of Service of Process: A statement that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
  • Physical or Electronic Signature: Your physical or electronic signature.

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be subject to liability for damages.
